Terms of Service

1. Service description

PrivaGuard provides automated website cookie scanning, consent banner generation, and privacy policy generation tools to help Swiss businesses comply with the Federal Act on Data Protection (nDSG). The service is provided "as is" and is not a substitute for qualified legal advice.

2. Accounts

When creating an account, you agree to:

• Provide accurate and complete registration information
• Keep your account credentials secure and not share them with third parties
• Notify us immediately at contact@privaguard.ch if you suspect unauthorised access

3. Payments and billing

Paid subscriptions are billed monthly or annually in advance. All prices are in Swiss Francs (CHF) and exclude VAT where applicable.

• Payments are processed via Stripe. By subscribing, you authorise recurring charges to your payment method.
• Subscriptions auto-renew unless cancelled before the renewal date.
• We reserve the right to change prices with 30 days' notice. Continued use after the price change constitutes acceptance.

4. Cancellation and refunds

You may cancel your subscription at any time from your account settings.

• Cancellation takes effect at the end of the current billing period. You retain access until then.
• We do not offer pro-rata refunds for unused subscription time, except where required by Swiss law.

5. Acceptable use

You may not use PrivaGuard to scan websites you do not own or have explicit permission to scan. You may not attempt to circumvent our rate limits, reverse-engineer our systems, or use the service for any illegal purpose. We reserve the right to suspend accounts that violate these terms without notice.

6. Limitation of liability

PrivaGuard provides compliance assistance tools but does not guarantee that use of our service will result in full legal compliance. We are not liable for fines, penalties, or legal costs arising from your data protection practices. To the fullest extent permitted by Swiss law, our total liability is limited to the amounts you paid us in the 12 months preceding the claim.

7. Changes to these terms

We may modify these Terms of Service at any time. We will notify you by email at least 14 days before material changes take effect. If you do not agree to the new terms, you may cancel your subscription before the effective date.
